W Fitness Terms & Conditions

 

Thank you for choosing W Fitness to help you on your fitness journey! We can’t wait for you to start working out with us! Please read the T&C's for your appropriate membership.

Definitions: W Fitness = "we", "us", "our", or “gym”; Customer = "you", “your”.

12 Month Membership

1. Membership

1.1 Your membership will begin on the day you join.

1.2 Your membership is personal to you. You cannot transfer it to another person.

1.3 You are committing to a 12-month membership which will then go onto a rolling month-by-month contract.

1.3.1 Your membership includes: Unlimited access to the circuit (within our opening hours); a full induction and programme card; 1 programme review per calendar month; measurement review every 3 calendar months; and unlimited classes per week (you may ask to see our list of classes which are included).

1.3.2 It is at W Fitness’ discretion to determine when the programme and measurement reviews will take place, dependant on, but not limited to, how often you have attended the gym.

1.3.3 W Fitness reserves the right to change the membership package at any time. We will give you 14 days’ notice of this change in writing to the email address you have given us.

1.4 You may cancel the automatic renewal of this contract at any time by providing at least 1 Months’ notice in writing or by e-mail (wfitnesshorsforth@gmail.com) to W Fitness.

2. Fees

2.1. You must pay a monthly membership of £35 per month.

2.2. Monthly instalments will be due on either the 1st of each calendar month or the next available working day by Direct Debit.

2.3. Monthly fees are payable even if you do not use the Fitness studio.

2.4 After your 12 month contract ends, your membership will go onto a rolling month-by-month contract of £35. You are then able to cancel this by providing us with 30 days’ written notice to wfitnesshorsforth@gmail.com.

3. W Fitness Rules

3.1. You must comply with the fitness studio rules/etiquette which forms part of this agreement.

3.2. We may change the rules/etiquette at any time. We will post notice of any changes at the studio.

3.3 You must use our booking-in system to use the circuit. If you do not book in, you may be refused access to the circuit.

3.3.1 The last time you may access the circuit is 30 minutes before closing. If you arrive after this time, you may be refused access into the gym.

3.4 You must use our booking-in system to attend a class. If you do not book in, you may be refused admittance.

4. Changing the Agreement

4.1. We can change the agreement at any time. We will give you 14 days’ notice of this change in writing to the email address you have given us.

5. Facilities

5.1. You are entitled to use the facilities available for your category of membership package.

5.2. You may have to pay additional charges to use certain other facilities/activities at the fitness studio. You can get a list of these from our reception point. We can change these prices at any time.

5.3. Before using any exercise equipment, you must read and sign the Medical Questionnaire and PARQ Form and have a supervised induction session. We can refuse access to the fitness studio facilities if we consider your health may be adversely affected by the use of such facilities. In such circumstances you will need to see your GP.

5.4. The fitness studio may open/close earlier during public holiday periods. Facilities may also close for occasional special events. Notices will be displayed in the fitness studio in advance notifying customers of any changes. No refunds will be available for these periods.

5.5. We may change the fitness studio’s opening times or withdraw any of the facilities at any time if we need them for events or other special activities.

5.6. We may need to close a facility or part of it for repair/refurbishment on the grounds of health and safety or improving customer service. Fitness classes may also have to be cancelled due to unforeseen instructor unavailability. In the above circumstances we will use our best endeavours to:

5.6.1. Give as much notice as is reasonably practicable by displaying notices in the fitness studio.

5.6.2. Arrange for alternative facilities during a period of closure.

5.7. Your membership does not give you priority over other users or guarantee the availability of facilities.

5.8. W Fitness management reserve the right to change the activity programme. Prior notice will be given in the fitness studio relating to activity cancellations or the introduction of new sessions.

5.9. Certain promotions do not apply to existing members.

6. Junior Members and Children.

6.1. If you are 14-17 (inclusive) your parent or guardian must sign this agreement on your behalf. By signing this agreement your parent or guardian agrees to be responsible for your behaviour and actions at all times and to pay us any amounts that are due on your behalf.

6.2. When you reach 18 your junior membership will end and you will automatically and immediately become a full adult member and sign a copy of this agreement.

7. Cancelling Your Membership

7.1. Memberships cannot be cancelled prior to the agreed contract length that you have signed up for and the last payment has been made.  

7.2 W Fitness will continue to collect your monthly subscription after the minimum period. Should you not wish to continue subscribing after the Minimum Period, you must give notice to cancel the contract at least 1 calendar month before the final payment of the minimum period. If you wish to cancel after the minimum period this requires 30 days’ notice in writing to W Fitness (e-mail: wfitnesshorsforth@gmail.com, or in writing: Park Centre, Station Road, Horsforth, LS18 5NX). Your 30 days’ notice will start once this letter or email is received, for which a confirmation email will be sent back. Queries on cancelled memberships can only be dealt with when a copy of this letter is provided.

7.3 We calculate your membership in whole calendar months. This means that the following applies. Anywhere in these terms and conditions where we ask you to give notice of one calendar month or more, if you give notice during a month, we will treat it as if we received it on the first day of the following month and the notice period will run from that day. For example, if you need to give us one month’s notice to end your membership and we receive your notice on 23 May, your notice will start from 1 June, it will run out on 30 June. Your membership will end on 30 June and you will pay one more direct debit (on 1 June) after giving notice.

7.4 Direct Debits should not be cancelled by the member as this will incur an admin charge.

7.5 Once your membership has been cancelled, we will advise you of your last payment date and the last day you may use the facilities.

8. Termination of Service, Limited Rights to Cancel

8.1 During the Minimum Period you may cancel the contract only:
8.1.1. If we fail to maintain the standard of service you would reasonably expect.
8.1.2. If we alter the operating hours of the services unreasonably resulting in you being subsequently unable to access the services.
8.1.3. If you develop a medical condition which prevents you from using the services on an ongoing basis. An appropriate medical practitioner must provide written evidence that this is so.*
8.1.4. If you move away from the area by a distance of 10 miles (as shown on Google Maps). We shall require evidence that such a move has taken place*
8.1.5. If you lose your employment and are subsequently unable to keep up your repayments under this contract. You must produce documentary evidence and we may, at our discretion, suspend your payments for two months. We will then review your financial situation with you.*
8.1.6. If you become pregnant. You must produce documentary evidence and we may, at our discretion, suspend payments for three months. We will then review your situation with you.*
*PLEASE NOTE: points 8.1.3 – 8.1.6 require documentation, this can only be accepted from the date of receipt.

We require 30 days’ notice in writing. Your 30 days’ notice starts once we receive this letter or email.
9. Termination Payment for Early Cancellation
9.1 If you cancel your subscription during the Minimum Period, other than in the circumstances set out above, we shall be entitled to a termination payment.
9.2 The Termination Payment will be the total of:
9.2.1. Any arrears;
9.2.2. Any accumulated late payment charges that have been or will be incurred; and
9.2.3. The monthly subscriptions that would otherwise have fallen due before the end of the Minimum Period.
9.3 You will be given credit for early payment, and this will be in the form of a discount applied against the total that you have to pay.
10. Missing Payments
10.1 If you miss two payments, you will be deemed to have breached your contract.

11. Freezing Your Monthly Payments

11.1 At our discretion, you are able to freeze your monthly payments if:

11.1.1 You lose your employment and are subsequently unable to keep up your repayments under this contract. You must produce documentary evidence and after 2 months suspension with no charge [as stated in 8.1.5], you may freeze for a further 3 months at a rate of £5 per month retainer to hold your membership place.*

11.1.2 You become pregnant. You must produce documentary evidence and after three months suspension with no charge [as stated in 8.1.6], you may freeze for a further 3 months at a rate of £5 per month retainer to hold your membership place.*

11.1.3 You develop a medical condition which prevents you from using the services on an ongoing basis. An appropriate medical practitioner must provide written evidence that this is so. Due to the complex nature of medical conditions, you may suspend your account for three months with no charge, after this you may freeze for a further three months at a rate of £5 per month as a retainer to hold your membership. After this your account will be assessed on a month by month basis at the rate of £5 per month.

*After the maximum period for freezing your account, you will be required to resume paying your full membership monthly payment.

12. Collecting Your Monthly Subscriptions
12.1 Go Cardless / Stripe is our agent for the collection of your monthly subscriptions. Go Cardless / Stripe will collect your subscription monthly in advance on our behalf by Direct Debit.
12.2 If you fail to make a payment on time, you will incur the following charges:
12.2.1. Fail to pay the subscription on the due date £15.00.
12.2.2. Fail to pay the missed subscription within 7 days of the date of a reminder correspondence, an additional £15.00 charge (total £30.00).
12.2.3. Fail to pay the arrears and accrued charges within 7 days of the date of a Final Notice, an additional £15.00 charge (total £45.00).
12.3 Late payment charges become payable immediately when they are incurred.
12.4 W Fitness will serve notice and collect any Termination Payment which becomes due. Any notice served on you in accordance with the terms of this contract, will be deemed to have been delivered to you the next day after it is despatched by us.
12.5 If you would like to make a complaint with the service you have received from W Fitness, this should be in writing or by e-mail to (wfitnesscomplaints@gmail.com).
12.6 If you fail to pay any amount due under this agreement for a period of more than 30 days, then we may pass the debt to a third party company for collection. The costs incurred in employing the third party company will be borne by you including the costs in tracing you should you have changed address without telling us.

13. Privacy and Data Protection
13.1 We take great care to ensure that any information we hold about you is kept safe and secure. This section explains how and why Go Cardless / Stripe and W Fitness use your personal information.
13.2 Go Cardless / Stripe and W Fitness need to collect and process personal information in order to be able to provide you with the services. The personal information required includes:
13.2.1. your personal details (such as your name, address, date of birth, telephone number and email)
13.2.2. financial information (such as bank account details)
13.2.3. medical information.
13.3 Your details and financial information
W Fitness and Go Cardless / Stripe require this information in order to collect and process payments. W Fitness and Go Cardless / Stripe will also use the information for related purposes, e.g. keeping records of financial transactions for a number of years (as required by law and the Direct Debit Indemnity) or to pursue unpaid debts. W Fitness may anonymise and aggregate data (so that it no longer identifies you) and then use it for analysis and reporting purposes. Some of the information W Fitness collects and processes will also be shared with Go Cardless / Stripe (e.g. details of a missed payment).
13.4 Medical information
In order to take out a subscription, W Fitness, needs to know about your health and any conditions or injuries you suffer from (this is to make sure that you can make use of the services safely and without risking injury). When subscribing you will be asked to provide certain sensitive personal data about your medical history. This information is provided on the basis of your consent, and you do not have to provide it. However, if you choose not to provide these details, then W Fitness cannot be held responsible for any injury caused relating to information not provided.
If you do decide to provide this information, it will be stored with W Fitness. You can, of course, withdraw your consent to our using this sensitive personal data whenever you wish. However, by withdrawing your consent you will also be accepting liability for any injury caused through withdrawing this information. If you should wish to terminate your contract due to withdrawing this information, and this cancellation takes place during the Minimum Period, you will be liable to make a Termination Payment (as set out above).

3 Month Membership

2.4 After your 1 month contract ends, your membership will go onto a rolling month-by-month contract of £55. You are then able to cancel this by providing us with 30 days’ written notice to wfitnesshorsforth@gmail.com.

5.6.1. Give as much notice as is reasonably practicable by displaying notices in the fitness studio.

5.6.2. Arrange for alternative facilities during a period of closure.

5.7. Your membership does not give you priority over other users or guarantee the availability of facilities.

5.8. W Fitness management reserve the right to change the activity programme. Prior notice will be given in the fitness studio relating to activity cancellations or the introduction of new sessions.

5.9. Certain promotions do not apply to existing members.

6. Junior Members and Children.

6.1. If you are 14-17 (inclusive) your parent or guardian must sign this agreement on your behalf. By signing this agreement your parent or guardian agrees to be responsible for your behaviour and actions at all times and to pay us any amounts that are due on your behalf.

6.2. When you reach 18 your junior membership will end and you will automatically and immediately become a full adult member and sign a copy of this agreement.

7. Cancelling Your Membership

7.1. Memberships cannot be cancelled prior to the agreed contract length that you have signed up for and the last payment has been made.  

7.2 W Fitness will continue to collect your monthly subscription after the minimum period. Should you not wish to continue subscribing after the Minimum Period, you must give notice to cancel the contract at least 7 days before the final payment of the minimum period. If you wish to cancel after the minimum period this requires 30 days’ notice in writing to W Fitness (e-mail: wfitnesshorsforth@gmail.com, or in writing: Park Centre, Station Road, Horsforth, LS18 5NX). Your 30 days’ notice will start once this letter or email is received, for which a confirmation email will be sent back. Queries on cancelled memberships can only be dealt with when a copy of this letter is provided.

7.3 We calculate your membership in whole calendar months. This means that the following applies. Anywhere in these terms and conditions where we ask you to give notice of one calendar month or more, if you give notice during a month, we will treat it as if we received it on the first day of the following month and the notice period will run from that day. For example, if you need to give us one month’s notice to end your membership and we receive your notice on 23 May, your notice will start from 1 June, it will run out on 30 June. Your membership will end on 30 June and you will pay one more direct debit (on 1 June) after giving notice.

7.4 Direct Debits should not be cancelled by the member as this will incur an admin charge.

7.5 Once your membership has been cancelled, we will advise you of your last payment date and the last day you may use the facilities.

8. Termination of Service, Limited Rights to Cancel

8.1 During the Minimum Period you may cancel the contract only:
8.1.1. If we fail to maintain the standard of service you would reasonably expect.
8.1.2. If we alter the operating hours of the services unreasonably resulting in you being subsequently unable to access the services.
8.1.3. If you develop a medical condition which prevents you from using the services on an ongoing basis. An appropriate medical practitioner must provide written evidence that this is so.*
8.1.4. If you move away from the area by a distance of 10 miles (as shown on Google Maps). We shall require evidence that such a move has taken place*
8.1.5. If you lose your employment and are subsequently unable to keep up your repayments under this contract. You must produce documentary evidence and we may, at our discretion, suspend your payments for two months. We will then review your financial situation with you.*
8.1.6. If you become pregnant. You must produce documentary evidence and we may, at our discretion, suspend payments for three months. We will then review your situation with you.*
*PLEASE NOTE: points 8.1.3 – 8.1.6 require documentation, this can only be accepted from the date of receipt.

We require 30 days’ notice in writing. Your 30 days’ notice starts once we receive this letter or email.
9. Termination Payment for Early Cancellation
9.1 If you cancel your subscription during the Minimum Period, other than in the circumstances set out above, we shall be entitled to a termination payment.
9.2 The Termination Payment will be the total of:
9.2.1. Any arrears;
9.2.2. Any accumulated late payment charges that have been or will be incurred; and
9.2.3. The monthly subscriptions that would otherwise have fallen due before the end of the Minimum Period.
9.3 You will be given credit for early payment, and this will be in the form of a discount applied against the total that you have to pay.
10. Missing Payments
10.1 If you miss two payments, you will be deemed to have breached your contract.

11. Freezing Your Monthly Payments

11.1 At our discretion, you are able to freeze your monthly payments if:

11.1.1 You lose your employment and are subsequently unable to keep up your repayments under this contract. You must produce documentary evidence and after 2 months suspension with no charge [as stated in 8.1.5], you may freeze for a further 3 months at a rate of £5 per month retainer to hold your membership place.*

11.1.2 You become pregnant. You must produce documentary evidence and after three months suspension with no charge [as stated in 8.1.6], you may freeze for a further 3 months at a rate of £5 per month retainer to hold your membership place.*

11.1.3 You develop a medical condition which prevents you from using the services on an ongoing basis. An appropriate medical practitioner must provide written evidence that this is so. Due to the complex nature of medical conditions, you may suspend your account for three months with no charge, after this you may freeze for a further three months at a rate of £5 per month as a retainer to hold your membership. After this your account will be assessed on a month by month basis at the rate of £5 per month.

*After the maximum period for freezing your account, you will be required to resume paying your full membership monthly payment.

12. Collecting Your Monthly Subscriptions
12.1 Go Cardless / Stripe is our agent for the collection of your monthly subscriptions. Go Cardless / Stripe will collect your subscription monthly in advance on our behalf by Direct Debit.
12.2 If you fail to make a payment on time, you will incur the following charges:
12.2.1. Fail to pay the subscription on the due date £15.00.
12.2.2. Fail to pay the missed subscription within 7 days of the date of a reminder correspondence, an additional £15.00 charge (total £30.00).
12.2.3. Fail to pay the arrears and accrued charges within 7 days of the date of a Final Notice, an additional £15.00 charge (total £45.00).
12.3 Late payment charges become payable immediately when they are incurred.
12.4 W Fitness will serve notice and collect any Termination Payment which becomes due. Any notice served on you in accordance with the terms of this contract, will be deemed to have been delivered to you the next day after it is despatched by us.
12.5 If you would like to make a complaint with the service you have received from W Fitness, this should be in writing or by e-mail to (wfitnesscomplaints@gmail.com).
12.6 If you fail to pay any amount due under this agreement for a period of more than 30 days, then we may pass the debt to a third party company for collection. The costs incurred in employing the third party company will be borne by you including the costs in tracing you should you have changed address without telling us.

13. Privacy and Data Protection
13.1 We take great care to ensure that any information we hold about you is kept safe and secure. This section explains how and why Go Cardless / Stripe and W Fitness use your personal information.
13.2 Go Cardless / Stripe and W Fitness need to collect and process personal information in order to be able to provide you with the services. The personal information required includes:
13.2.1. your personal details (such as your name, address, date of birth, telephone number and email)
13.2.2. financial information (such as bank account details)
13.2.3. medical information.
13.3 Your details and financial information
W Fitness and Go Cardless / Stripe require this information in order to collect and process payments. W Fitness and Go Cardless / Stripe will also use the information for related purposes, e.g. keeping records of financial transactions for a number of years (as required by law and the Direct Debit Indemnity) or to pursue unpaid debts. W Fitness may anonymise and aggregate data (so that it no longer identifies you) and then use it for analysis and reporting purposes. Some of the information W Fitness collects and processes will also be shared with Go Cardless / Stripe (e.g. details of a missed payment).
13.4 Medical information
In order to take out a subscription, W Fitness, needs to know about your health and any conditions or injuries you suffer from (this is to make sure that you can make use of the services safely and without risking injury). When subscribing you will be asked to provide certain sensitive personal data about your medical history. This information is provided on the basis of your consent, and you do not have to provide it. However, if you choose not to provide these details, then W Fitness cannot be held responsible for any injury caused relating to information not provided.
If you do decide to provide this information, it will be stored with W Fitness. You can, of course, withdraw your consent to our using this sensitive personal data whenever you wish. However, by withdrawing your consent you will also be accepting liability for any injury caused through withdrawing this information. If you should wish to terminate your contract due to withdrawing this information, and this cancellation takes place during the Minimum Period, you will be liable to make a Termination Payment (as set out above).
